No Further Action

Post by Angel786 » Fri Jan 18, 2019 9:58 pm

I am a local councillor, my parents left the family home to me and I was falsely accused of child pornography by my brother.

7 months ago the police searched and seized goods from my property, I was not arrested or charged. During the search they found a flashlight taser that I confiscated from some children in a park in my role as a councillor. I was not worried about the allegation as I knew there was nothing there but was worried about the taser. I contacted the DC who led the search in July who sent an email saying “we have decided not to take any further action against you regarding the flashlight, but it will not be returned”, last week a new DC returned my items and said that they just need to decide what action to take regarding the flashlight.

I’m really worried and was hoping someone could advise me on where I stand legally? Can they just change their mind after saying no action will be taken?

They can. NFA doesn't mean Innocent. It just means that they don't have enough information to prosecute. I'm sure you've figured that put by now anyway. That's a very serious accusation. I would have sued my brother if he'd done that to me. Have you taken any action?
